Here are some answers to the many questions I'm asked about DUI Laws and procedures in Washington State. The categories of questions are as follows:

This is the first and last time I will be arrested for a DUI. I found Mark

myself for my DOL hearing because I would lose.

Washington State Drunk Driving Misc Questions:
- Will I be able to get my case dismissed because I was not read my
rights?
- Will I go to jail?
- I had two alcohol offenses when I was younger. What will happen to
my license if I have a third conviction?
- I have three serious offenses within seven years, what will become
of my license?
- How many hours of alcohol classes will I have to take?
- What will happen if I do not complete the classes or public
service ordered by the Washington State Courts?

Will I be able to get my case dismissed because I was not read my
rights?
Probably not. But if you were interrogated after being placed in
custody, your statements can not be used against you.
Will I go to jail?
While there are mandatory minimums if you plead guilty, or are found guilty of a
DUI in WA, an experienced attorney may be able to keep you out of jail.
I had two alcohol offenses when I was younger. What will happen to
my license if I have a third conviction?
You face two Washington State agencies who will attempt to revoke your
driver's license. The answer to this question is when your last case was, and if it can be considered a prior.
I have three serious offenses within seven years, what will become
of my license?
You face a four year loss of license by both the Washington State court and the
WA Department of Licensing.
How many hours of alcohol classes will I have to take?
In Washington State, the best-case scenario is an eight hour Alcohol/Drug Information School (ADIS). The ADIS is obtainable if there is no proof of either an alcohol/drug abuse issue, or if there is no proof of alcohol/drug dependence. If you are abusing alcohol (you have a history of alcohol/drug related crimes like DUI or you have a high blood alcohol reading) you may be attending treatment for some time. Also, if you are dependent on alcohol/drugs you may be attending treatment for two years. Self-help Meetings (AA) are usually reserved for people who are abusing alcohol/drugs or are dependent on alcohol or drugs.
What will happen if I do not complete the classes or public
service ordered by the Washington State Courts?
You will go to jail.
I lost my Washington license. May I obtain a license in another state.
In most cases, no.
If I obtain an international driver's license, may I drive in
Washington State, even though my Washington license is revoked?

Am I a bad person, because I was arrested for DUI?
No, bad things happen to good people, but you are well advised never, never smell like alcohol while behind the wheel.
What if I burped within 15 minutes of blowing?
The breath machine may have read alcohol from your stomach rather
than you lungs. The result may be incorrect. A similar problem occurs
with dentures.
Can I do a Deferred Prosecution?
The answer is maybe. A deferred prosecution is not to be entered into lightly. You must be aware of the risks and rewards of successfully completing (or not completing) this intense program. Call me to further discuss this option, and ask for a four page special report regarding a deferred
